La futura Ley tiene como objetivo garantizar unas mejores condiciones para el desarrollo y uso de esta tecnolog\u00eda, adem\u00e1s de estimular la inversi\u00f3n y la innovaci\u00f3n<\/p>\n

La implementaci\u00f3n de la nueva ley europea de Inteligencia Artificial<\/a> ha puesto de manifiesto la necesidad de definir l\u00edmites legales y \u00e9ticos para esta tecnolog\u00eda. El prop\u00f3sito principal de la norma es asegurar que los sistemas de inteligencia artificial comercializados en Europa cumplan con est\u00e1ndares de seguridad y respeten los valores y derechos fundamentales de la Uni\u00f3n Europea (UE).<\/p>\n

Desde la firma suiza de software especializada en soluciones deep tech, ERNI Consulting Espa\u00f1a, Alberto Mart\u00edn, director de Tecnolog\u00eda e Innovaci\u00f3n, explica que \u00absi bien esta Ley de IA representa un hito hist\u00f3rico, es necesario establecer normas concretas y sin lagunas, ya que la ambig\u00fcedad en estas podr\u00eda ralentizar el proceso y limitar el potencial transformador de la IA\u00bb.<\/p>\n

Y es que esta ley, pionera a nivel mundial, aspira a regular el uso de la IA adaptando un enfoque \u00abbasado en el riesgo\u00bb y aplicando reglas m\u00e1s estrictas seg\u00fan de qu\u00e9 manera pueda afectar a la seguridad los sistemas de IA comercializados en el mercado europeo.<\/p>\n

Dos visiones de la Ley de IA<\/h2>\n

Desde ERNI se\u00f1alan que esta nueva normativa presenta una dualidad importante: por un lado, la norma act\u00faa como una garant\u00eda de \u00abfiltro de calidad\u00bb para los proyectos de IA aprobados y destinados al uso comercial, sin embargo, las barreras operativas y la amenaza de multas excesivas podr\u00edan convertirse en un obst\u00e1culo para la innovaci\u00f3n, especialmente para las peque\u00f1as empresas y startups.<\/p>\n

Paralelamente, la ley pone sobre la mesa una clasificaci\u00f3n del riesgo que pueden llegar a representar los diferentes sistemas de IA (riesgo m\u00ednimo, alto riesgo, riesgo inadmisible). Por ejemplo, la ley contempla como \u00abalto riesgo\u00bb<\/a>  los sistemas de IA que se utilicen en productos sujetos a la legislaci\u00f3n de la UE sobre seguridad de los productos, incluyendo los dispositivos m\u00e9dicos.<\/p>\n

En este caso, desde ERNI Consulting explican que en el \u00e1mbito m\u00e9dico, una IA no podr\u00e1 tomar decisiones para los pacientes, y en cualquier caso, un sistema de inteligencia artificial siempre se considerar\u00e1 de alto riesgo si elabora perfiles de personas f\u00edsicas.<\/p>\n

Finalmente, dependiendo de la infracci\u00f3n y el tama\u00f1o de la empresa, el incumplimiento de esta ley en la UE implicar\u00e1 multas que oscilan entre los 35 millones de euros o el 7% de la facturaci\u00f3n global y los 7,5 millones o el 1,5% de la facturaci\u00f3n.<\/p>\n","protected":false},"excerpt":{"rendered":"
